The problem is that people sue the school, despite the fact that the act of physically disciplining the kid is perfectly legal in their state. The case is eventually dismissed, but school boards are not smart enough to ask for legal fees in return for the expenses in defending themselves from the case brought against them... Here's a key term you should all know to understand why things like parents suing schools for disciplining the student happen: CYOA: Cover Your Own Ass. Basically, the superintendent, the principals, Vice Principals, Teachers and Counselors ALL want to avoid a parent problem where they may end up in court because win or lose, its bad publicity for the school district, and reflects badly on them jointly and severally in the eyes of the general public. As such, these people generally go to great lengths to avoid incurring parental wrath, including passing kids who did not deserve to be passed, giving out inflated grades, and just avoiding disciplining, or in reality teaching a student because the student, in their mind, is less of a danger along with his parent if he just sits in the back and skates through the year to the next teachers classroom and becomes their problem... its almost a cold war "Containment" mentality. Basically, if the legislatures would make it so a parent could only sue a school or teacher for actual abuse of the student, sexual, physical, or emotional, and bar all other cases based on teacher meted discipline, the schools would improve, in my opinion... It also would help if they paid teachers about 1/3 more than they do now, at minimum, so people with actual talent for the job are willing to work the job... honestly, why teach chemistry for 32K a year when you can go work private sector as a chemist, in the least paid job for 55K?
